On July 17, 2017, the U.S. Citizenship and Immigration Services (USCIS) announced the publication of a revised version of Form I-9, Employment Eligibility Verification.
What Employers Need to Know
- Employers may use the new form, with a revision date of 07/17/17 N now. Using the new form is mandatory on September 18, 2017 to avoid fines.
- The previous I-9 form, with a revision date of 11/14/16 N, can be used through September 17, 2017.
- Current storage and retention rules are unchanged.
- The List of Acceptable Documents was amended. List C was renumbered and now includes Consular Report of Birth Abroad (Form FS-240).
- DO NOT recertify I-9’s for current employees. The revised Form I-9 is ONLY to be used for new hires.
USCIS has also revised its Handbook for Employers: Guidance for Completing Form I-9 to assist employers in using the new form.
